During an investigation of a reported Asbestos fibre release during fabric maintenance work on Package 7 North Bulkhead, on 10 April 2022, on your Forties C installation I found that you first determined that you had unintentionally disturbed asbestos, and thereby released a substance which could cause a significant risk of personal injury to a person, on 11 June 2022. You notified the Health and Safety Executive of this occurrence on 10 August 2022 and sent a report of that incident to the Health and Safety Executive, in an approved manner, on 15 August 2022, i.e. 45 days working days after the occurrence had been confirmed.
You therefore failed to notify the relevant enforcing authority of this reportable incident by the quickest practicable means without delay, and failed to send a report of that incident in an approved manner to the relevant enforcing authority within 10 days of the incident.
During an offshore inspection on your Forties D installation, on 24-26 March 2021, HSE determined that two prior dangerous occurrences had not been reported to HSE, and you subsequently reported these incidents. HSE wrote a letter to you on 30 April 2021, requiring you to review your arrangements for reporting incidents to ensure that they meet the relevant offshore reporting regulations. You wrote to HSE on 25 May 2021 stating that you were updating your Incident Reporting and Investigation procedure (ANS-IRI-001). You have not yet made changes and published this procedure. |
